NEW YORK (R.Kelly Fans Website) - In yet another step toward R. Kelly's legal vindication, a Florida judge today threw out the evidence that had been the basis for child-pornography charges filed 14 months ago against Kelly by authorities in Polk County, Florida. The child pornography case against R&B singer R. Kelly appears to be on shaky ground after a judge ruled Thursday that photographs of Kelly allegedly having sex with an underage girl were illegally seized by the Polk County Sheriff's Office and cannot be used as evidence.
Circuit Judge Dennis Maloney ruled detectives did not have enough evidence to justify a search of Kelly's rented Davenport home in June 2002.

The most critical piece of evidence was a digital camera containing 12 nude pictures of an underage girl. Detectives found the camera wrapped in a towel inside a duffel bag in Kelly's private bedroom.
Without the photographs, prosecutors have no case against the 37-year-old singer, whose real name is Robert Sylvester Kelly.

Outside the courtroom, Genson talked with Kelly by phone moments after the judge made his ruling. At Thursday's hearing, Bartow defense lawyer Ron Toward argued the affidavit detectives submitted in support of their request for a warrant to search his home for child pornography failed to establish probable cause.
