Emilio Castillo and Stephen Kupka, collectively and professionally known as Tower of Power, by and through their attorneys at Audet & Partners, LLP, a San Francisco, California-based trial law firm, and the Law Offices of Lopez & Associates, have filed a class action complaint (Case # 1531) in the United States District Court for the Northern District of California against Warner
Music Group Corp. The case arises out of the alleged failure of Warner Music to pay the full royalty rates to artists such as Tower of Power on revenue generated from the licensing of digital downloads and/or ringtones.
"From the information we have received, it appears Warner
Music has allegedly failed to pay Tower of Power and its other artists the amount owed on the licensing of songs for digital downloads and ringtones," stated Plaintiffs' attorney Joshua C. Ezrin of Audet & Partners, LLP. "Emilio and Stephen are bringing this action to ensure all artists are properly paid for their work."
Tower of Power (or TOP for short) is an American R&B-based band, originating in Oakland, California, that has been performing for over 43 years. They are best known for their funky soul sound highlighted by a powerful horn section. Emilio "Mimi" Castillo (born September 24, 1950, Detroit, Michigan) is a saxophone player and composer and is best known as the founder of the band. Stephen "Doc" Kupka (a.k.a.
