This 5-minute segment gives some examples on how to deal with potential hearsay issues, including determining whether the hearsay rule applies, what constitutes non-hearsay by law or rule, what is excepted from hearsay, among other items. Two examples involve 1) a will contest where we have a husband and wife, each who have 2 kids from prior marriages. Each will says they first give everything to their spouse, but if one spouse died before them, then the spouse wants the items to go to their respective children. There is a plain crash and a question arises as to who died first; and 2) a bank teller wants to testify as to the contents of a note handed to her from a bank robber.
