New York, NY (Top40 Charts/ Kirby Shields Official Website) - Sean Combs, aka "P. Diddy," has been put on notice by the law firm of Fagerholm & Jefferson, retained by singer Kirby Shields, for alleged unauthorized use of composition; copyright infringement; and breach of contract for the use of the song, "I'm Just Getting Started." Said song was subsequently recorded by Day26 and re-titled, "Just Getting Started."

The claim was sent on July 27, 2009 to Christian Davis Stalnecker, d/b/a Sly Doggie Productions; Bad Boy Records/Atlantic Records; and possibly other parties.

According to the letter, it is alleged that Stalnecker entered into an agreement on November 27, 2007, to produce thirteen (13) songs as a work-for-hire and later violated a signed contract with Shields that contains a "Re-Recording Restriction," that states in part:

"Producer agrees that the (M)asters are exclusively produced for Artist and that Producer shall not produce the same or same Master(s) hereunder for any other person, firm or corporation, for the purpose of producing master recordings or other products or devices derived therefrom."

According to the letter, Shields purchased said songs for the amount of $30,500 dollars in 2007, and that on April 14, 2009, Bad Boy Record's (P. Diddy's "boy group"), Day26, released the album "Forever In A Day," which includes the song, "Just Getting Started."

According to the letter, the album by Day26, "Forever In A Day," reached number two (2) on Billboard Charts, and number one (1) on Billboard's R&B charts. The resemblance between the two songs is undoubtedly clear.
