 NEW YORK (Bon Jovi Official Website) - U.S. District Court judge for the Southern District of New York denied a request by DownloadCard, Inc., to stop the release of Bon Jovi's latest effort, Bounce, on Friday (Oct. 4), according to the Associated Press. As a result, Bounce will hit stores as scheduled on Tuesday (Oct. 8), although the judge did rule that DownloadCard raised enough questions to warrant a trial, if the company chooses to pursue further litigation. The issue at hand surrounds a program called American XS, which has been used by the Universal Music Group to promote Bounce since Sept. 16. DownloadCard is alleging the software is a copy of its own product that was offered to UMG and denied. To that end, DownloadCard is alleging theft of trade secrets to the tune of $750,000. Each copy of Bounce has a unique PIN that purchasers can then use to register for exclusive Bon Jovi emails at the band's official Web site.
DownloadCard alleges it already worked with UMG on recent PIN promotions with Rusted Root, Musiq, and Shelby Lynne, among others, and that the idea behind the Bon Jovi promotion was its own.
